Apple Files New Lawsuits Against Samsung in Germany

Apple has filed two new lawsuits in Germany against Samsung for allegedly infringing upon Apple’s design patents. Both lawsuits were filed in Dusseldorf Regional Court and target 10 Samsung smartphones and 5 Samsung tablets.  The targeted smartphones include the Galaxy S Plus and the S II. The lawsuit in regards to the tablets appears to be focused around the Galaxy Tab 10.1N.  Samsung recently introduced the Galaxy Tab 10.1N that featured a new bezel and a slightly modified design. Apple filed their new lawsuit seeking to ban sales of the modified tablet, but the Germany Court advised that they were not likely to grant an injunction against Samsung.  The Court did not explain their unwillingness to issue an injunction. A Germany Appeals Court, who apparently did not have any pressing cases to hear, also made a statement about their doubts regarding Apple’s European Union design right, which was the major factor behind the original Galaxy Tab 10.1 injunction. The new lawsuit regarding the tablets was not filed under an emergency proceeding, which allows Apple a new procedure against both tablets.  Based upon the statements of both Courts, it appears that Apple has a long up hill battle with their new lawsuits.  Samsung has not yet responded but is aware of the new lawsuits.
